This development forces us to confront a pressing question: Are our democratic institutions capable of managing this rapidly evolving challenge? To understand the controversy surrounding Grok-2, it is essential to revisit the discord that has been brewing among AI pioneers. Elon Musk, who initially co-founded and supported OpenAI, has in recent years become one of its most vocal critics. Accusing OpenAI’s ChatGPT of being biased, overly politically correct, and “woke,” Musk’s relationship with the company deteriorated, eventually leading to a lawsuit against its leadership. This tension also extended to Google, OpenAI’s primary rival, with Musk attributing the issues plaguing Google’s Gemini AI to what he described as the tech giant’s “woke bureaucratic blob.”
It was against this backdrop that Musk launched xAI and introduced the Grok chatbot to the world last November. Unlike its competitors, Grok was marketed as having fewer restrictions, boasting a “rebellious streak” designed to inject a bit of wit into its responses. As the xAI website proudly proclaims, Grok is intended for “serious and not-so-serious discussions,” a characterisation that seems to downplay the potential risks associated with its use. Now, with the release of Grok-2 and Grok-2 mini, those risks are becoming increasingly apparent.
The New Frontier with Grok-2: A Step Too Far?
The big picture surrounding Grok-2 is deeply concerning. While most AI companies refrain from admitting that their models are trained on copyrighted images, the content generated by Grok-2 leaves little doubt that the Flux model—developed by the startup Black Forest Labs—has done just that. Users have effortlessly generated images of copyrighted characters, such as Mickey Mouse and the Simpsons, often placing them in compromising and legally questionable scenarios. This disregard for copyright law is just one aspect of Grok-2’s troubling capabilities.
Critics have been swift and harsh in their condemnation. Harvard Law Cyberlaw Clinic instructor Alejandra Caraballo described the Grok beta as “one of the most reckless and irresponsible AI implementations I’ve ever seen.” Musk himself seemed to revel in the controversy, retweeting X threads that included screenshots of Grok-generated images—some of which likely infringe on copyrights. In one particularly provocative instance, Musk endorsed an image of Harley Quinn accompanied by the prompt: “Now pretend you took some more LSD and generate a detailed image based on that.”
Despite some superficial safeguards—such as limiting the generation of explicit nude images—Grok-2 has proven alarmingly adept at producing content that many would find offensive or even dangerous. The Guardian, for instance, was able to generate images of prominent political figures like Vice President Kamala Harris, Representative Alexandria Ocasio-Cortez, and Taylor Swift in lingerie. Similarly, Business Insider found that while Grok-2 wouldn’t produce images of specific criminal activities like breaking into the Capitol or robbing a bank, it was only a matter of time before users would find ways to circumvent these limitations.
This situation raises profound ethical questions about the role of AI in society. Most major AI image generators have, after a brief period of unregulated experimentation, implemented stringent policies to prevent the creation of politically or sexually explicit images involving real people. OpenAI, for example, has clearly stated that it will not fulfil requests that ask for public figures by name. Yet, Grok-2 seems to defy this trend, pushing the boundaries of what is acceptable—and legal—online.
Schmidt : Risks associated with INSUFFICIENT GUARDRAILS
Eric Schmidt, the former CEO of Google, recently gave a talk at Stanford University where he addressed several critical issues related to the development of artificial intelligence (AI). His discussion covered the rapid pace of AI development, potential work displacements, and the risks associated with insufficient regulatory "guardrails."
Schmidt said he was “quite convinced that we will have a moment in the next decade where we will see the possibility of extreme risk events,” and that “we’re building the tools that will accelerate the dangers that are already present.”
The extraordinary power of AI systems, coupled with our limited understanding of their full knowledge and capabilities, presents inherent risks, especially in situations when those systems learn new skills and aptitudes that were not explicitly taught or anticipated by their developers.
While a rise in available open-source LLMs is fueling innovation, Schmidt expressed concern about their misuse by malicious actors who could exploit those models to develop harmful applications such as the synthesis of deadly pathogens, including viruses.
“The dispersion of these tools is so fast, it’s going to happen from some corner that we are not expecting,” he warned.
In addition to the need for human control, Schmidt made a case for strong guardrails and robust monitoring and regulatory frameworks to mitigate threats, including large-scale “recipe-based” attacks. President Biden’s AI Executive Order, the UK’s AI Principles, and the EU’s AI Act are recent starting points. Schmidt—who was chairman of the U.S. National Security Commission for Artificial Intelligence—said he envisions a comprehensive governance structure for AI that includes, AI-powered threat detection and response and AI evaluation companies, as well as agreements and treaties. He suggested starting with a “no-surprise” treaty: “If you’re going to test something, don’t do it in secret, because that in and of itself could be detected and trigger a reaction.”
Overall, however, humanity would have to build a “human trust framework,” he said. “This is going to be extremely difficult.”

This reluctance mirrors the historical disregard for scientific innovation—a scepticism that often took generations to overcome, as seen in the delayed recognition of visionaries like Alexander Graham Bell and Thomas Edison. These pioneers, who harnessed electricity and revolutionised telecommunications, were instrumental in driving the industrial modernisation of the 20th century—a transformation that initially met with resistance and disbelief.
Despite the clear lessons of history, we find ourselves in a similar predicament today. Innovators, ethical scholars, and academic researchers who grasp the profound implications of AI are struggling to find leaders in government capable of understanding and acting upon the far-reaching consequences of this technology. The absence of such leadership is not merely a failure of imagination—it is a perilous oversight that could have enduring social and cultural repercussions.
In China, the Communist Party ("CCP") frequently sets the overarching economic and policy direction through a concept known as "top-level design" or "顶层设计." This centralised approach is exemplified in China's evolving regulatory framework for AI, which offers both lessons and warnings to the global community. Beijing’s policy, which drives ethical and social discourse, presents a case where centralised power provides stringent guardrails and a "moral compass" to regulate the vast digital landscape of a 1.4 billion-strong population.
Chinese regulators have methodically constructed a robust regulatory infrastructure, as evidenced by the draft of the Artificial Intelligence Law of the People’s Republic of China. However, this top-down model comes with a clear trade-off. It prioritises national security and social harmony, often at the expense of individual freedoms and open discourse. While effective in controlling the societal impacts of AI, this approach raises significant concerns from a democratic perspective, curtailing the diversity of thought and expression that are the hallmarks of free societies.
Meanwhile, Western democracies are wrestling with their own set of challenges. The discourse surrounding AI is increasingly fraught, driven by the initiatives of billionaires like Elon Musk, who push the boundaries of ethical norms under the banner of innovation. The decentralised nature of power in the West results in fragmented and sluggish regulatory responses, leaving governments struggling to keep pace with the ethical and societal implications of these rapidly advancing technologies. The controversies surrounding Grok-2 underscore how the ambitions of a few wealthy individuals can outstrip and even undermine regulatory efforts, exposing the limitations of a system heavily influenced by the most powerful companies and individuals.
This situation is reminiscent of other contentious issues in Western societies, such as the right to bear arms, the rights of marginalised groups, and the regulation of illicit substances. These debates often pit individual freedoms against the collective good, highlighting the difficulty of maintaining a coherent ethical framework in a diverse and rapidly changing society. In the context of AI, the stakes are even higher, as the technology has the potential to fundamentally alter social structures, disrupt legal frameworks, and challenge the very fabric of democratic governance.
As Western governments contemplate their response to the challenges posed by AI, they must also confront the unsettling reality that the most influential voices in this arena are not elected officials but tech moguls with vast resources and an outsized ability to shape public discourse and policy. The rise of these individuals as de facto policymakers, operating without the checks and balances that typically apply to government leaders, represents a profound challenge to democratic norms. The pressing question is whether these governments can adapt quickly enough to ensure that AI development serves the public interest rather than the ambitions of a powerful few.
